Can 1 suspended license driver sue a non-licensed driver who caused an accident?

My son was in a car accident tonight. He was driving in the left hand turn lane when a girl shot out of a restaurant driveway and plowed into him. It looks like his car may be totaled (yea, she did that much damage). Here is the catch: she may be an unlicensed and possibly uninsured teen driver, my son was driving on a suspended license. The police said even though the girl was completely at fault, we cannot go after her for the damages she has caused. We realize my son was also in the wrong, but it doesn't seem right that her big SUV has a ding in its bumper and my son's new car is totaled and he must bear the loss. This is in Colorado, is there a way to go after the driver and make her pay for the damage she has caused? The police officer seemed to think because both drivers had license issues nothing can be done.
